2. Client Responsibilities
The client agrees to:
- Provide accurate and complete information required for the project.
- Deliver content, images, logos, and other required materials within agreed timelines.
- Review submitted work and provide timely feedback.
- Make payments according to the agreed schedule.
- Ensure that all provided content does not violate any intellectual property or applicable laws.
Project delays caused by the client shall not be considered the responsibility of KAF Infotech LLP.
3. Quotations & Pricing
All quotations are valid for 30 days from the date of issue unless otherwise stated. Project pricing is based on the agreed scope of work. Any additional features, revisions beyond the agreed scope, or change requests may incur additional charges.
4. Payments
Projects generally require an advance payment before work begins. Unless otherwise agreed:
- A project begins only after the required advance payment is received.
- Remaining payments must be made according to the agreed milestones or invoice schedule.
- Late payments may result in project delays, suspension of services, or additional charges.
KAF Infotech LLP reserves the right to pause ongoing work until outstanding payments are cleared.
5. Project Timelines
Estimated delivery timelines are based on:
- Timely client approvals
- Availability of required content
- Timely communication
Delays caused by the client, third-party services, hosting providers, payment gateways, or unforeseen circumstances may extend delivery schedules.
6. Revisions
Reasonable revisions are included according to the agreed project scope. Requests beyond the agreed number of revisions or major changes after approval may be treated as additional work and billed separately.
7. Intellectual Property
All project files, source code, graphics, designs, documents, and related assets remain the property of KAF Infotech LLP until full payment has been received. Upon receipt of full payment, ownership of the final deliverables specifically agreed to be transferred will pass to the client.
KAF Infotech LLP reserves the right to showcase completed projects in its portfolio, social media, marketing materials, and case studies unless otherwise agreed in writing.
8. Third-Party Services
Projects may involve third-party services such as:
- Domain Registrars
- Hosting Providers
- Payment Gateways
- Google Services
- Meta Platforms
- AI Platforms
- Premium Plugins & Licensed Themes
- APIs
KAF Infotech LLP is not responsible for interruptions, policy changes, service outages, pricing changes, or technical issues arising from third-party providers.
9. Website & Software Warranty
Unless otherwise specified in writing:
- Minor bugs reported within the agreed support period will be addressed.
- Requests for new features or functionality enhancements are not considered bug fixes and may incur additional charges.
KAF Infotech LLP does not guarantee uninterrupted operation of websites or software due to factors beyond our control.
10. Digital Marketing Disclaimer
Digital marketing performance depends on numerous external factors, including market competition, audience behavior, advertising platforms, and search engine algorithms. Accordingly, KAF Infotech LLP does not guarantee:
- Specific rankings
- Sales
- Leads
- Revenue
- Website traffic
- Advertisement performance
- Return on Investment (ROI)
We commit to using professional industry practices to optimize campaign performance.
11. Confidentiality
Both parties agree to keep confidential information shared during the course of the project private and not disclose it to third parties unless required by law or with prior written consent.
12. Limitation of Liability
To the maximum extent permitted by law, KAF Infotech LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of the use of our services. Our maximum liability shall not exceed the total amount paid by the client for the specific service giving rise to the claim.
13. Suspension or Termination
KAF Infotech LLP reserves the right to suspend or terminate services if:
- Payments remain overdue.
- The client engages in abusive or unlawful conduct.
- False or misleading information is provided.
- The client requests activities that violate applicable laws or platform policies.
Termination does not waive the client's obligation to pay for work already completed.
14. Cancellation & Refunds
Cancellation and refund requests shall be governed by our Refund & Cancellation Policy. By purchasing our services, you acknowledge that you have read and accepted that policy.
15. Privacy
Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
16. Force Majeure
KAF Infotech LLP shall not be held responsible for delays or failure to perform due to events beyond reasonable control, including but not limited to natural disasters, government actions, internet outages, cyberattacks, pandemics, strikes, or failures of third-party infrastructure.
17. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India, unless otherwise required by applicable law.
